Opinion Papers

After careful consideration, the ALAA Board of Directors approved filing an Amicus brief in the Supreme Court of Alabama.

This is in response to the Alabama Department of Public Health appealing the Wynnwood I case to the highest court. In doing so, ADPH made certain assertions about the regulatory authority of ADPH and the assisted living providers throughout Alabama.

ALAA had no choice but to provide the court a “friend of the court” brief clarifying our support of strong but fair regulation and preserving the circuit court system as a legitimate check to the power of the Department of Public Health,

The Association has not “sued” anyone. In behalf of all licensed providers, the Association, by filing this brief, assures that the Court will have a clear understanding of all the issues.
